1. Acceptance of Terms

By accessing or using the ReachHQ platform, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. Your use of our website and services may involve third-party tracking for analytics and advertising (e.g. Google Analytics, Google Ads) as described in our Privacy Policy. Where required by law (e.g. in the EEA and UK), we obtain your consent before using non-essential cookies or such tracking. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Account Registration

You must register for an account to access our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to use our platform to send unsolicited emails (spam), violate any applicable laws (including CAN-SPAM, CASL, GDPR, ePrivacy, CCPA/CPRA), or harass or harm others. You must respect the unsubscribe preferences of all contacts and maintain compliance with all relevant anti-spam and data-protection regulations. When connecting third-party services (e.g. Google Workspace, Gmail, Microsoft), you must comply with their terms of service and policies. We use third-party services for analytics and advertising in accordance with our Privacy Policy and applicable law (including Google's policies and EU consent requirements where applicable).

4. Service Level

We strive to maintain 99.9% uptime for our platform. However, scheduled maintenance windows, force majeure events, and factors beyond our reasonable control may result in temporary service interruptions. We will provide advance notice for planned maintenance.

5. Payment & Billing

Paid plans are billed on a recurring basis (monthly or annually). You authorize us to charge your payment method at the start of each billing cycle. You may cancel your subscription at any time, effective at the end of the current billing period.

Some products or services may be offered as a one-time purchase. You authorize us to charge your payment method at the time of purchase; one-time purchases are not recurring.

6. Third-party services, analytics, and advertising

Our website and services may use third-party services for analytics (e.g. Google Analytics) and advertising (e.g. Google Ads, Meta Ads (Facebook/Instagram), remarketing, and similar social media advertising platforms). These providers may collect and process data as described in our Privacy Policy. In the EEA and UK we obtain your consent for non-essential tracking in line with the ePrivacy Directive and GDPR. Use of our site constitutes acceptance of our use of such technologies in accordance with our Privacy Policy and applicable law. Our use of Google services complies with Google's EU user consent policy and related requirements where consent is required.

7. Data Ownership

You retain all ownership rights to the data you upload and create within ReachHQ. We do not claim ownership of your contacts, sequences, campaign content, or analytics data. Upon account termination, you may export your data.

8. Limitation of Liability

To the maximum extent permitted by law, ReachHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of revenue, data, or business opportunities.

9. Termination

We may terminate or suspend your account at any time if you violate these Terms of Service. You may terminate your account at any time by contacting our support team. Upon termination, your right to use the platform will immediately cease.
